Terms of Service

These terms are a contract between the learning center that signs up ("you," "your center") and ClassCheckpoint ("we," "us"), operated by Double H Ventures LLC. By creating an account or using the service, you agree to them. If you're accepting on behalf of a center, you confirm you have authority to bind it. ClassCheckpoint is a business tool for education providers. It is not offered to consumers, parents, or students directly.

1. What the service is

ClassCheckpoint is software for learning centers: student check-in and check-out with session records, a front-desk kiosk, attendance dashboards and history, session feedback, staff task tracking, lead management, message templates, analytics, and summary reports. Features may improve or change over time; we won't materially reduce the core service you're paying for during a paid term.

2. What the service is not

ClassCheckpoint is a record-keeping and notification tool. It is not a supervision system, a security system, or a guarantee of any student's safety, presence, or whereabouts. Your center remains solely responsible for the physical supervision, custody, and release of students, for verifying that records reflect reality, and for its own safety procedures. Records can be wrong: a student may forget to check out, a staff member may mis-enter data, a device may be offline. You agree not to rely on the service as a substitute for direct supervision.

Your center's data belongs to your center. Student records, attendance history, leads, and everything else you put in stays yours. You grant us the limited rights needed to host, process, back up, and display it in order to run the service, and for nothing else. We act as your service provider: we do not sell your data, use it for advertising, or use identifiable student data to build anything other than your service. Details, including the short list of infrastructure providers that process data on our behalf, are in the Privacy Policy, which is part of these terms.

You can export your data at any time while your subscription is active. Attendance records are retained for the life of your subscription (at least two years of history is maintained to support common record-keeping requirements).

6. Term, cancellation, and what happens after

You can cancel from your account or by email, effective at the end of the current billing period. We may suspend or terminate an account for non-payment, for material breach of these terms, or for use that threatens the security or integrity of the service, with notice and a chance to fix the problem where practical.

After termination you have 60 days to export your data (we'll help if you ask). After that window we delete your center's data from live systems within 90 days, with backup copies aging out on our normal backup cycle.

7. Our software

We own the ClassCheckpoint software and everything about it except your data. Your subscription is a right to use it, not a transfer of ownership. If you send us feedback or suggestions, we can use them without obligation (improving the product for you is the point.

8. Disclaimers

We work hard to keep the service accurate, secure, and available, and we use commercially reasonable efforts to do so, but the service is provided "as is." We don't warrant that it will be uninterrupted, error-free, or that every record will be accurate, and we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the extent the law allows.

9. Limitation of liability

To the maximum extent permitted by law: (a) neither party is liable to the other for indirect, incidental, special, or consequential damages, or lost profits; and (b) our total liability arising out of the service is capped at the fees your center paid us in the 12 months before the claim arose. In particular, and consistent with Section 2, we are not liable for injuries, losses, or incidents arising from your center's supervision, custody, or release of students. Nothing in these terms limits liability that cannot be limited by law.

10. Indemnification

Your center will defend and hold us harmless from third-party claims arising out of your use of the service in breach of these terms, including claims arising from a failure to obtain required parental consents or from your center's supervision or release decisions.

11. Independence

ClassCheckpoint is an independent product. It is not affiliated with, endorsed by, sponsored by, or connected to any educational franchisor or brand. Any franchise or program names that may appear in your own center's data are yours, not ours.

12. Disputes and governing law

These terms are governed by California law. Any dispute will be resolved in the state or federal courts located in Alameda County, California, and both parties consent to that venue. If any part of these terms is found unenforceable, the rest still applies.

13. Changes to these terms

If we make material changes, we'll email your account contact at least 30 days before they take effect. Continuing to use the service after that date means you accept the updated terms; if you don't, you may cancel and Section 6 applies.
